Employee Comment: Open Access for Theses and Dissertations

The University invites comments on a revised proposed Presidential Policy on Open Access for Theses and Dissertations.

The policy is new and includes the following key issues:

  • There is currently no system-wide uniformity or policy for ensuring open access to UC graduate students' theses and dissertations. This policy will provide system-wide consistency for these works.
  • Allowance for embargoes that delay the date theses or dissertations are made available in an open access repository.

Employee Comment: Task Force Recommendations of University-wide Policing

The University invites comments on the Task Force recommendations of University-wide policing.

As you may be aware, President Napolitano initiated a task force in April of this year to examine university-wide policing policies and processes in order to provide a final report of recommendations by December 31. The Task Force has been working diligently for the last eight months to craft these recommendations based off of policing best practices, policies, and laws. The Task Force is requesting your input and feedback on the recommendations before finalizing the report.

Marijuana use and possession on UC property

Dear Colleagues,

On Jan. 1, 2018, the legal sale of recreational marijuana commenced in California. This followed the passage of Proposition 64 by California voters on Nov. 8, 2016, which legalized its recreational use by people over the age of 21. However, Prop. 64 does not change UC policy, which prohibits marijuana on all university property and at all university events, with limited exceptions for approved academic research.

Notwithstanding Prop. 64, using, distributing and possessing marijuana remains illegal under federal law. The Drug Free Schools and Communities Act and the Drug Free Workplace Act require that UC, as a recipient of federal funding, establish policies that prohibit marijuana use, possession and distribution on campus and in the workplace.

New, revised and rescinded UC Presidential Policies announced

Changes to several UC Presidential Policies regarding relocation, travel, financial deficit management, probationary periods and payroll pertain to ANR members. The new, revised and rescinded UC Presidential Policies can be viewed at http://policy.ucop.edu. Below is an outline of the changes.

BFB-G-13 Policy and Regulations Governing Moving and Relocation

The core changes that went into effect on Oct. 15, 2017, include the following:

  • removed policy on relocation allowance;
  • added provision allowing the reimbursement of reasonable expenses associated with the sale of former primary residence or unexpired lease expenses associated with new appointment;
  • added repayment provisions requiring new appointees to reimburse moving and relocation expenses if the appointees voluntarily separate from the position prior to completing one year of service;
  • clarified the reimbursement of meals while in temporary living quarters; and
  • revised to require submission of nontaxable expenses reimbursement requests within a reasonable amount of time not to exceed 60 days.

BFB-G-28 Travel Regulation Policy

The core changes that are effective immediately, relate to travel within the continental U.S. under 30 days and include the following:

  • reduction in the lower maximum daily meals and incidentals reimbursement from $7 4 to $62; and
  • establishment of a maximum lodging reimbursement rate of $275 per night, before taxes and mandatory hotel fees.

Exceptions are allowed if a hotel rate at $275 is not available. Traveler must submit additional documentation, such as price comparisons within the proximity of the meeting location, that supports the higher lodging rate incurred. Price comparisons should be performed at the time of booking. Pre-arranged conference lodging rates in excess of $275 per night do not require an exceptional approval.

Revised PPSM-22: Probationary Period has undergone a technical review

To comply with the policy review requirement, as well as the Working Smarter Initiative directive to incorporate policies where appropriate.

Revisions to the policy include the following:

  • incorporation of the probationary language from PPSM-61: Release During the Probationary Period or from Limited, Casual I Restricted, and Floater Appointments; and
  • updating definitions with PPSM-3: Types of Appointment updates and remove any common term definitions and including a reference to PPSM-2: Definitions.

Rescinded Policies

PPSM-61: Release During the Probationary Period or from Limited, Casual/Restricted, and Floater Positions.

The majority of the policy language and content has been incorporated into the recently approved revised PPSM-3: Types of Appointment, and the remaining probationary language has been incorporated into the attached revised PPSM-22: Probationary Period Policy. 

AM-P-196-30 Payroll: OASDI and Medicare Contributions

This Accounting Manual Chapter was determined to be more a procedural/guideline and not a Presidential policy. This procedure will be moved into the Accounting Manual SharePoint site.

UC releases principles in support of UC community members

Dear Colleagues,

UC Office of the President has issued a statement of its principles regarding the privacy and civil rights of undocumented members of the UC community. These principles may be of interest to UC ANR volunteers, program participants and other stakeholders.

In the press release, UC President Janet Napolitano said, “While we still do not know what policies and practices the incoming federal administration may adopt, given the many public pronouncements made during the presidential campaign and its aftermath, we felt it necessary to reaffirm that UC will act upon its deeply held conviction that all members of our community have the right to work, study, and live safely and without fear at all UC locations.”

UC contractors and vendors must comply with fair wage plan

As described in Human Resources' Oct. 14, ANR Update email, the UC Fair Wage/Fair Work Plan became effective Oct. 1, 2015. It is important to note that the plan applies not only to UC personnel, but also to contractors/vendors doing business with and providing services to UC. The UC Fair Wage/Fair Work Plan also provides measures to ensure contractor compliance including a dedicated telephone hotline (1-855-WAGES-UC) and webpage by which contract workers may report complaints directly to the Office of the President.

As the first university in the country to voluntarily set a minimum wage, compliance with this requirement will be scrutinized carefully. To ensure compliance, effective immediately it is imperative that UC ANR personnel do not allow contractors and/or vendors to perform work or provide services to UC ANR unless and until a properly authorized UC agreement is in place. (Common types of UC ANR work or services that are subject to the Fair Wage policy include repair services, farm labor contractor services, agricultural services, construction services, etc.)

UC policy has always required that an authorized UC purchase order (or other appropriate form of contract) be executed before work begins. With the implementation of the UC Fair Wage/Fair Work Plan, however, it is critical that UC ANR obtain services only from firms that will execute a contract guaranteeing payment of the plan's minimum wage, as described in UC's factsheet. Accordingly, the vendor's willingness to do this must be confirmed prior to the start of work.

Allowing work to proceed before an appropriately authorized UC purchase order is issued will be considered a breach of UC policy (an unauthorized purchase), and is very likely to trigger new/additional administrative requirements, cause delay and impede payment to the vendor.
