Facility Rule: Processing Food Safety

Preventive Controls Rule (aka Facility Rule): Requires that food facilities have safety plans that set forth how they will identify and minimize hazards. For facilities that manufacture, process, pack or hold food for human consumption.

Where your operation likely falls within the FSMA is determined by reviewing a three year average your annual sales and where the produce is sold or the type of processing your operation is doing.

NOTE: Even if your operation is “exempt” from the Facilities Rule it is still held to CA Dept of Public Health CDPH's Processed Food Registration requirements.

NOTE: The following tables are only intended as a starting point to help you find where your operation likely falls within the Facility Rules, use it in conjunction with the flow chart link above and Facility Rule details below.

PREVENTIVE CONTROLS (FACILITY) RULE

Annual processed foods sales (3-year average) 
The dollar amounts are annually adjusted for inflation in March, to find the current factor, visit FSMA Inflation Adjusted Cut Offs.

The following are required elements of good manufacturing practices as outlined by the Code of Federal Regulations, 21 CFR 117:

  • Facility (buildings and equipment) 
    Bread
  • Sanitation
  • Human Hygiene
  • Processes and controls* -- Food Safety Plan
  • Pest Control
  • Training
  • Records*
    *Greater emphasis on these items with FSMA.

Food Safety Plan

A set of written documents that is based on food safety principals. This is a dynamic document and must be kept current. The Preventive Controls Rule requires that the Food Safety Plan have at least the following components:
  • The risk evaluation
  • Hazard analysis methodology and results
  • Supplier evaluation
  • Identification of the Preventive Controls
  • The supply-chain control program, as required
  • A recall plan

Dates for FSMA Facility Rule

  • Jan 2016: Record retention for ALL operations (to support qualified exemption)
  • Aug 2017: Small Business
  • Aug 2018: Very Small Business 

NOTE: Qualified operations (exempt) are determined by an average of prior three years sales.
